Our Chapter 7 Bankruptcy Practice
In a Chapter 7 bankruptcy proceeding, also known as liquidation bankruptcy, you are allowed to permanently discharge certain debts. When you file for protection, you are immediately protected by the "automatic stay" set forth in the bankruptcy laws, which prohibits your creditors from calling you, sending you letters or pursuing legal action to collect the debt.
Under the 2005 revisions to the bankruptcy laws, you must now submit to a "means test" to determine whether you are eligible to permanently discharge your debts under Chapter 7. We will walk you through the test, and if you qualify, we will take the time to carefully explain before you file what debts can be wiped out, as well as what property you can keep, so that you get the relief you seek. If you choose to move forward, we will prepare and file all required documentation to complete the process, and we will be your representative in all meetings or hearings with creditors, the bankruptcy trustee, or the court.
In a Chapter 7 petition, you can generally discharge unsecured obligations such as credit card debt and medical bills. You cannot get rid of child support arrearages, student loans and certain tax obligations. You can keep some assets, including a certain amount of value in your home or car, as well as other personal property.
